Terms and Conditions for Owner Participation

in VRBO “Bear Stay” Program

The following describes the terms on which the VRBO Bear Stay Program is offered to owners with listings on VRBO.com (“Owners”).

By participating in the VRBO Bear Stay Program (the “Bear Stay Program” or the “Program”) you agree to comply with and be legally bound by the following terms and conditions ("Terms"). Please review the following terms carefully. If you do not agree to these terms, you have no right to participate in the Bear Stay Program.  We reserve the right to modify these Terms or policies relating to the Bear Stay Program at any time. You are responsible for reviewing these Terms. By participating in the Bear Stay Program, you agree that the posting of new or revised terms and conditions on VRBO will constitute adequate and constructive notice to you of any and all revisions and changes. Continued use of the Bear Stay Program after any such changes or after explicitly accepting the new Terms shall constitute your consent to such changes.

1.  Eligibility .  Participation in the Bear Stay Program is limited to:

(a) Owners with listings on VRBO.com,

(b) that have listings at least six months old at the time of the stay, and

(c) that are current on all payments to VRBO.com at both the time of the request and the time of the stay. 

2.  Description of Program .  A Bear Stay is a one (1) week “free” stay by an employee of VRBO.com or HomeAway .com (“Employee”) at a participating Bear Stay Listing.  A “Bear Stay Listing” is a listing of a vacation rental property on VRBO.com for which the Owner or Property Manager has agreed to these Terms.  A Bear Stay is a rental relationship directly between the eligible Employee and the participating Owner.

3.  Requirements .  Owners participating in the Bear Stay Program acknowledge and agree that:

(a) Bear Stays are limited to one (1) week (although Owner and Employee may agree to extend the stay at the Employee’s sole cost and expense);

(b) The relationship of the Owner is with the individual Employee directly and is not with VRBO.com, HomeAway or any of its subsidiaries or affiliates;

(c)  Owners will not charge the Employee any rental amount for the Bear Stay but may collect cleaning costs, taxes and any other fees related to the Bear Stay from the Employee;

(d)  Owners will hold the Employee individually responsible for any damages to the property during their Bear Stay; 

(e)  Owner hereby releases, indemnifies and holds harmless VRBO.com, HomeAway and any of its subsidiaries and affiliates from and against any and all rentals costs, fees, charges, taxes, or damages related in any way with the Bear Stay, including but not limited to failure of the Employee to abide by the terms of the Program,  provide a review, or provide a review acceptable to Owner;

(f)  Promotion of the Bear Stay on VRBO.com is at the sole and unfettered discretion of VRBO.com, which promotion VRBO.com may change at any time without notice to Owner;

(j) HomeAway and any of its subsidiaries and affiliates are not a party to any agreement between the Employee and the Owner and no third party beneficiary rights are created by the Program.
